Morgan Carter Personal Injury Solicitors in Oldham, Manchester: Review

When our 1to1Legal team first started out in 1999, we worked solely on personal injury claims. We didn't start branching out into other areas such as wills, conveyancing, business or family law until 2007. That's one of the reasons accident claims still make up the majority of case types coming through our network. That's also why we like to keep a few specialists on board rather than them all being general practice firms.

Morgan Carter is one of those 'specialists' dealing only in matters such as road accidents and accidents at work. We imagine that most people believe that solicitors can run compensation cases standing on their heads. That may be true for a simple whiplash. Working out the compensatory amounts due for an accident and injuries that have already happened and are over with certainly are child's play with today's resources. However, calculating, proving and fighting for the amounts needed for people facing life and health problems long after the case is over - is a far more tricky task.

Although Morgan Carter's website is full of the standard pitchings you would expect from a solicitor - e.g. phrases such as "we pride ourselves on putting our clients first", or "you are not just a case your a person" (sic), and even "your customer satisfaction is important to us" - they do make some very solid promises that go beyond what we've seen from most firms:

" - Cases are set up on our state-of-the-art case management system within 24 hours of your instruction.
  - Dedicated case handler appointed within 2 hours of receiving a case.
  - All calls and emails returned within 4 hours.
  - Majority of cases settled within 3 months of initial instruction."

No vagueness or textbook language in that little lot. As with most personal injury cases, you should expect quite a thorough discussion for free before going ahead with any case too. (Unlike divorce, crime, or similar cases where the facts of the case usually make no difference as to whether it will be taken on.)

In England and Wales you should expect any road or work accident claim to be handled with no fees up front and no fees at the end. This is because most law firms will handle a case on a no win, no fee basis. That means, if the case loses, you don't have to pay anything. However, you should also get 100% compensation. That means the law firm takes no cut of your winnings, they get all their fees paid by the losing third party. However, these two terms and not interchangeable. If a firm does not promise you no win, no fee AND 100% compensation - then there is a good chance you have just signed away a chunk of your compensation to that law firm.

A road traffic accident claim is any case where you are seeking recompense for injuries and losses sustain due to an accident that wasn't your fault within the last 3 years. Accidents at work are also governed by the 3 year rule and also must contain an element of actionable, provable and suffered injury. Any similar accident that occurred in a public area such as supermarket, park, pavement, shop or so on will come under those rules.

Morgan Carter however also specialise in Serious Injury claims. That is where the effects of the injury are usually long lasting and investigations, calculations and debates have to made about how much your injuries may cost you overall in the future and how much suffering will there be - not merely how much loss there has been.

Why Choose Morgan Carter Solicitors? In their own words, they say they will fight your case, that they care, that they are specialists, they they offer clear advice, cut out jargon and settle cases quickly. To that end, if you have been involved in an accident, they say they will instruct independent engineers to value the damage to your vehicle, arrange a replacement, securely store your damaged vehicle and more whilst also handling your case for the vehicle damage numbers, the vehicle hire charges and so on.

We got a little confused during our regular website checks though. We checked the usual variants and www.morgancarter.com is a completely different company. However, there is another website at www.mcsolicitors.co.uk (www.mcsolicitors.com goes somewhere else) which whilst not an identical copy, clearly belongs to the firm and offers the same services. The only difference we could really see was that the main site lists a Manchester phone number, whereas the alternative site lists an 0800 number. Both work.

General Notes: Usually if Legal Aid is possible we've mentioned it above, but you can always ask. We haven't looked in depth at their recruitment program so are unaware of any job vacancies available. For a career with Morgan Carter Solicitors it's best to visit the website (www.morgancarter.co.uk), check opening hours, and find the correct phone/email contact details. Simply emailing a CV to reception looks lazy. Each law firm's Law Society and/or SRA number should be on their site, usually at the bottom of each page.
