Kent Traffic Law in Maidstone, Sunil Rupasinha Motor Offence Barrister: Review
If you've used our site to find legal help in the past, you'll know we're very keen on specialists when it comes to things such as divorce, criminal law, medical negligence and motor offences. That doesn't mean general practice firms can't have a decent individual assigned to handle such things. But if it came down to choosing between a barrister that's been doing a mix of family, employment, injury, wills, etc. law for the past ten years and one who's been doing nothing but motor offence cases over the same period - then we would consider that a "no-brainer" unless there were significant mitigating circumstances such as cost.
This is especially true these days with an ever-increasing range of prosecutable motor offences including Drink Driving, Failure to Provide a Specimen, Speeding, Careless Driving, Drug Driving, Failure to Stop/Report an Accident, No Insurance, Driving while disqualified, Using a Mobile Phone, and more.
Usually our articles to try and point out things you might have missed about a firm or explain the between-the-lines stuff of each firm's sales pitch. But Kent Traffic Law already have a wide range of explanation articles of their own covering both the industry and selection process as a whole.
This review may therefore sound a little more positively bias than previous ones. But please do read through anyway, as we'll still point out exactly why we like them so much using links, quotes, comparisons and all the usual things you'd expect from us. :)
As I said, there are plenty of articles across this firm's website that would be considered good reading prior to calling up any law firm about your case: 'What is a Notice of Intended Prosecution?', 'What is a Section 172 Notice?', 'Requesting Early Removal' and more. We definitely recommend reading 'Motor Offence Solicitors Success rates. Too good to be true?' before continuing on your search for representation. It makes several valid points about how a firm saying they have a 100% success rate may absolutely being telling the 'truth', just not meaning exactly what you think it means.
Please note that Kent Traffic Law was set up by Sunil Rupasinha - a barrister. Regulated by the Bar Standards Board he is qualified to practice on a 'direct' or 'public access' basis. Prior to these new direct access rules, you had to hire a solicitor who would then hire a barrister to do all the court work and you paid for both. Under the new setup you can skip the solicitor and choose your own barrister directly. This obviously can save a considerable amount of time and money. We're hugely in favour of this and are dismayed at how little has been done to inform the public of this important change.
Anyway, to continue - Sunil practised from Chambers in London for 25 years handling driving offences and various other criminal cases across the full range of trial courts:
"... he was quickly promoted to list 'A' counsel on the Attorney General's list of advocates (reserved for only the best barristers on the list)"
"presented my case fantastically"
"I cannot recommend [Kent Traffic Law] highly enough"
"helped me to respond to the NIP in a considered and informed manner"
"a level of commitment you won't find anywhere else"
"standing in court with 15 points I walked away with a small fine"
"I pleaded 'guilty' to causing a crash whilst 3 times over the drink-drive limit. I then made off from the scene. Sunil was superb throughout and his skilful mitigation meant that I avoided a sentence of immediate imprisonment"
It's quite clear from even a summary flick through some of the site's pages that Kent Traffic Law is not in the habit of seeking ways around the law. There are even case studies such as this one here explaining in more detail how Sunil helped a client avoid a ban on reaching 12 licence points. We didn't see anything about loopholes or rule bending. Just ensuring the client used the already available defence options to their fullest.
There is definitely a distinct lack of "we'll get you off!" in the language of the firm's website, and more of a "we'll make sure you have the best possible defence" instead. That's a good thing. I've been doing this for 20+ years now and in my professional (and unfortunately personal) experience I've found firms who sound like they want to emulate the infamous Mr Loophole are also often the least experienced.
A quick note on navigation as we're dealing with a three word domain name. The official site we link to above is www.kenttrafficlaw.co.uk but with a double 't' in there and some easily switchable terms such as www.kenttrafficlawyer.co.uk or www.kentrafficlaw.co.uk we would recommend bookmarking the site once on it to save accidently coming back to the wrong one later. As they only handle motoring law, there is far less likelyhood of scammers hijacking your money (that's mostly just property solicitors) so it's more do to with saving you time and messing about. That is the only current valid site we know of though as www.sunilrupasinha.co.uk, www.kenttrafficlaw.com, and various other variants don't seem to be in use or redirecting.
General Notes: Usually if Legal Aid is possible we've mentioned it above, but you can always ask. We haven't looked in depth at their recruitment program so are unaware of any job vacancies available. For a career with Kent Traffic Law it's best to visit the website (www.kenttrafficlaw.co.uk), check opening hours, and find the correct phone/email contact details. Simply emailing a CV to reception looks lazy. Each law firm's Law Society and/or SRA number should be on their site, usually at the bottom of each page.
