They assist in obtaining an Education Health and Care Plan (EHCP) ensuring the plan is accurate, specific, and quantified. They also handle appeals against refusal to carry out an EHC needs assessment, refusal to issue an EHCP, and against the contents of an EHCP.

Education Law Service Ltd - Special Educational Needs Lawyer in London: Review

When it comes to most areas of law there are usually some general practice firms that cover it, some specialists, some barristers, and sometimes even non-law firms that can help you with the problem at a much reduced fee. For example Wills and many Tax matters can be handled by companies without any legal qualifications.

However there are some areas of law where the number of options simply aren't there. This is either because the types of cases are so niche, so complicated, or possibly not the most lucrative for a those considering their company's bottom line. Criminal Injury and Uninsured Driver cases are often like this because they involved pursuing money from the government. Not an insurer or other third party. Therefore the number of firms helping in those areas are much fewer.

One lesser known area of litigation is Special Education Needs work (SEN). Its lack of publicity is strange though because there are so many children within the UK involved with such setups and who could also use the help of a law firm with skills in this area. But why do we even need such lawyers? Surely there are organisations, laws, and procedures already in place to look after children in a country like ours?

The answer to that is - yes, there are systems in place. But just as with the NHS constantly providing a poor service, cutting corners, and even causing deaths by negligence - the special needs system within education is also run by fallible humans. Sometimes the only way to ensure your child gets the correct care is to get the legal system of the country to push back against the education system.

There are quite a few large firms that will take your Education Law case on. But just as a specialist individual Motor Offence barrister will typically charge much less and take far less time (compared to someone such as a multi-discipline solicitor within a larger firm) this is definitely another area of law where having a specialist could provide similar benefits.

The first quote in this article was from the Education Law Service Ltd's website. Another statement on their front page that stands out is:

"Evening and weekend appointments can be arranged."


This is actually rarer an offer than you might think. Even in this modern era of emails and video chat and smartphones - a huge percentage of law firms still hold tight to the old tradition of only being open 9am-5pm, Mon-Fri. If you've already been through a dozen law firm's sites today looking for one to help and didn't notice - just try typing a few of their company names into Google and see the opening hours that pop up.

A specialist like the Education Law Service that does such cases day in, day out (again, just like specialists for other legal matters) will likely cover a much wider range of work within that area of law. For example:

• "Making formal written representations to persuade a Local Authority to carry out an assessment"
• "Challenging a refusal to assess before the Special Educational Needs Tribunal"
• "Reviewing a draft Education Health and Care Plan"


With cases such as Divorce, Criminal Defence, and Bankrupctcy people are not very keen to share their personal experiences online. So when you see that the law firm you're interested in does not have many reviews on the usual forums such as Google, Trustpilot, Yell or Yelp - don't read negatively into that. It's just that people are much more likely to jump online to rant or rave about their new toaster than they are about such personal matters.

This applies to the Education Law Service Ltd firm as well. It was harder to find reviews at all on their company due to the branding (which we'll discuss later). But if you make sure to have the 'Ltd' part at the end of the name when searching, you should get the correct firm to pop up. Whilst ELS do display a few testimonials on their website e.g:

"highly professional, advice was thorough and fully informative"
"thank you for being very straightforward"


We found only one on the public boards. It was still very positive:

"excellent on the day ... and in phone contact throughout"


If you typically like a bit more before parting with any cash though, luckily there is a growing trend amongst legal practices to offer free consultations. In the past this usually only applied to cases that would be run on a no win, no fee basis anyway such as Personal Injury matters. But since Legal Aid got demolished by the government, Direct Access to barristers was introduced, and more people were setting up sole practitioner firms - law firm marketing has gotten much more competitive of late.

We've seen quite a few lawyers offering a full hour's face to face consultation to discuss your case for free. Some are less obliging offering just 15 minutes over the phone to help decide if it's a case they can handle and quote you for doing the work. Some will offer a reduced fee for the first consultation, up to a third of the usual hourly cost. That's still much better of course than charging you full price just for an introductory discussion about whether they can even help you.

A nice respectable middle offering that will hopefully let you get some information about what help is available, your chances, the costs, and for you to get a good enough feel for whether you like the person you will be working with.

A quick note on navigation as the firm uses quite generic terms for their branding. The official website we link to above is www.educationlawservice.com and www.educationlawservice.co.uk will redirect you there. However if you type 'education law service' or similar terms into a search engine such as 'education law firm' or just 'educational law service' - you may see several related web addresses such as www.educationlawbarristers.co.uk which are totally different firms.

Some other resources will pop up as well that might be helpful with some of the basics at least, including www.childlawadvice.org.uk Plus some organisations that may not be able to help you at all - for example www.educationlawassociation.org.uk An organisation looking to support the lawyers that are helping you. At the moment most scammers are targeting property solicitors and their clients because of the huge house deposits they are so easily obtaining. Just a couple of fake emails and house buyers/sellers end up handing over £millions every year to the fraudsters.

You never know what scam will be next though so always make sure you're on the correct site and never discuss payments or bank details via email. One last point made on the firm's website:

"We advise all parents/families to take early action, early intervention can be most effective."


For some types of legal matter you can have anything from several months to three whole years to address the issue and your case will be no better or worse off. However for Special Needs Education Law absolutely the sooner you're talking to someone with the expertise and experience to guide you - the better.

General Notes: Usually if Legal Aid is possible we've mentioned it above, but you can always ask. We haven't looked in depth at their recruitment program so are unaware of any job vacancies available. For a career with Education Law Service Ltd it's best to visit the website (www.educationlawservice.com), check opening hours, and find the correct phone/email contact details. Simply emailing a CV to reception looks lazy. Each law firm's Law Society and/or SRA number should be on their site, usually at the bottom of each page.
